The Platform For Your Application

In Kenya, developing an ios mobile app is more expensive than developing an equivalent android application.

The question is why? This is due to the fact that we have a scarcity of ios app developers (apple developers) in Kenya.

Also, maintenance of ios mobile application in Kenya is more expensive, unlike android where you pay 24 dollars to play store (which is a one time fee).

For ios apps, you have to pay 99 dollars each year for the app to remain in the app store.

The Features You Want in Your Mobile Application

The features you want to be embedded in the app play a huge role in determining the price you will be charged.

For example, if you want to integrate mpesa payment into your app that is counted as an extra feature and it may cost you more.

It is wise to only include the features which are very necessary for your business. The best advice I would give you is to first develop an app with minimal features(that is a minimum viable product and latter add features during maintenance).

  • The Sector for your Mobile Application

Basically, it will cost you more to develop you a mobile application in the health or financial sector due to the fact that they take more resources, time and expertise.

Also, mobile games can also be very costly to develop and maintain

  • Maintenance, Support, and Enhancements

It does not end there in having a mobile app for your business or services, it will require maintenance, support, and enhancement per time.

Once a mobile app is in the Appstore or Play store, it still needs some improvement. It is wise to talk with the app developer on how much it will cost you to maintain the app.

Mobile apps in Kenya can be very pricey to maintain especially if you never had an initial agreement with the app developer.

  • The App Developer Portfolio

Why some costs are higher than others is the fact that some mobile app development companies will ask for more money since they have a great brand that has a reputation for providing excellent work.

Some companies which are only startups can not afford to ask for that much since they are only starting off.

How To Patent An App in Kenya?

To patent, an app is to have an exclusive right over the app. There are so many apps out there most especially due to the increased use of smartphones and improved internet penetration worldwide.

Mobile apps are often created by software developers on behalf of their clients. In Kenya, to patent an App the developers or owners of mobile apps ensure that their legal rights are protected.

As such, the client and the software developer enters into an agreement which is written in clear terms on who owns the intellectual property rights in the mobile app. Where a client intends to ensure that its ideas are kept confidential, it may require the developer to execute a non-disclosure agreement.

In addition, where an employee develops a mobile app, the employer should ensure that the employment contract contains a clause stipulating that all intellectual property developed by the employee during the course of employment will be assigned to the employer.

Where the developer is a corporate entity such as a company, deeds of the assignment should also be executed by individual developers assigning all rights to the client. Where appropriate, the developers should also waive their moral rights in the mobile app developed. The waiver of moral rights would, for instance, ensure that the developers do not object to the treatment of the mobile app in ways that they would consider to be derogatory.

Different forms of protection for different purposes

Once a mobile app has been developed, it is important for the mobile app owner to consider the various forms of protection available. Protecting the mobile app will enable the owner to enforce its rights in the app in the event that it is infringed by third parties.

In this regard, the four main forms of legal protection that may be considered are trademarks, copyright, utility models and patents.

Copyright protects the various components of a mobile app such as source code, object code, graphics, and text.

Under Kenyan law, registration is not a prerequisite for copyright protection. Copyright protection accrues once work that is subject to copyright is recorded in a permanent form.

However, registration is still recommended since it constitutes prima facie evidence of copyright ownership.

Trademark registration, on the other hand, protects the name or logo of the mobile application. It is important that before any use or registration of the proposed trademark is undertaken, a trademark clearance search is carried out to confirm that the proposed trademark is available.

Trademark registration should ideally be undertaken in all the territories where it is envisaged that the mobile app will be used. An owner of a mobile app may go further and register a domain name in respect of the website that will be used together with the app.

It is generally recognized that a process or method embodied in an app may be patentable. In this regard, the manner in which a mobile app communicates with a server or another mobile device may be the subject matter of patentability. The requirements for patentability (such as novelty and inventive step) must be met. Patent protection is for 20 years from the filing date.

In instances where it is not possible to secure patent protection relating to a mobile app, it may be possible to obtain a utility model certificate. Under utility model protection, there is no requirement for an inventive step, as with the case of patent protection. Utility model protection is for 10 years from the filing date.

Terms and conditions should not be overlooked

In addition to the measures that could be taken to protect legal rights in a mobile app, the owner of an app should have in place terms and conditions set out when and how third parties may use the software.

The terms and conditions should also contain appropriate limitations of liability arising from the use of a mobile app.  Another critical requirement is a privacy policy to govern the manner in which the personal data of users will be collected and used.

Benefits of Building Your App With Developers in Kenya?

One of the benefits of building an app with Web Developers in Kenya is that during the terms of the agreement they are obligated to take care of the app like a guarantee for some months or years before payment can be made for periodic maintenance.

Another is that since they were the ones that developed the app, managing it for you will be a lot easier as they can easily manipulate the plugging to get the desired result. Either to expand it in the future or add new features to it.

Also, the cost of getting new features added to the app or maintenance costs is minimal since they were the originator of the app unlike when someone else is managing it.

The world is officially mobile and almost every major company with an internet presence is associated with an app that tailors and extends its services to the mobile user.

According to statistics, there are over 500 openings, full-time positions for mobile app developers in the United States with salary estimates ranging from $50K to $115K per year.

This is a huge market to explore, just get the skills and get going.
